Terms of Service

Citation Creation ("Citation Creation", "we", "us", or "our") is a product of Virtually Created Pty Ltd (ABN 90 695 908 975), a company registered in New South Wales, Australia. "Service" means our website and web application. "You" means the person or organisation that holds an account or otherwise uses the Service.

We may update these terms from time to time. When we make a significant change, we will update the date above and, where appropriate, notify you. Your continued use of the Service after a change means you accept the updated terms.

Your account

You are responsible for keeping your account and password secure, and for all activity that occurs under your account. We recommend enabling two-factor authentication.
You must provide accurate account information and keep it up to date.
You must be at least 16 years old to create an account. If you use the Service in an educational setting with students under 16, you are responsible for obtaining any necessary consents.
You are responsible for all content you create, upload, or store using the Service.

Acceptable use

When using the Service, you agree not to:

break any applicable law or regulation, or infringe anyone's intellectual property or privacy rights;
upload content you do not have the right to use, or that is unlawful, harmful, or malicious;
attempt to gain unauthorised access to the Service, other accounts, or our systems;
interfere with or disrupt the Service, or place an unreasonable load on our infrastructure (including via automated scraping or abuse of any API); or
resell or commercially exploit the Service without our permission.

We may suspend or terminate accounts that breach these terms.

Accuracy of citations and AI features

Citation Creation is designed to produce accurate, correctly formatted citations and to assist you with importing, extracting, and reviewing references, including through AI-assisted features. While we aim for a high degree of accuracy, we cannot and do not guarantee that every citation, extraction, or analysis produced by the Service is complete, correct, or free from error.

AI Import and Paper Review are not currently available. If enabled later and you choose to use them, AI Import and Paper Review may transmit submitted material to a third-party AI gateway, which routes requests to a downstream model provider. Transmitted material can include uploaded PDF or Word content, extracted document or bibliography text, individual reference text, the uploaded filename and file type, instructions for the requested task, and the selected model. We separately record operational response metadata such as token counts, reported cost, and request or generation identifiers for usage limits, billing, security, and troubleshooting.

The gateway states that it does not retain prompt content by default unless prompt logging is enabled. However, downstream model providers have different retention, logging, and model-training practices. Citation Creation does not currently enforce zero-data-retention routing on each request, so we do not promise that submitted material has zero retention, is never logged, or is never used for provider model improvement. Provider policies and routing can change; see our Privacy Policy section about AI processing for more detail.

Do not submit confidential, sensitive, embargoed, or unpublished material to AI Import or Paper Review unless you accept this third-party transmission and the applicable provider practices. You can add, edit, and format citations without using either feature.

Citation styles change over time, source material varies in quality, and AI-assisted features can occasionally misinterpret or omit information. You are responsible for reviewing and verifying all citations and outputs before relying on them or submitting, publishing, or otherwise using them. The Service is a tool to assist you, not a substitute for your own judgement or for the requirements of your institution, publisher, or assessor.

Plans, billing, and refunds

Citation Creation currently offers a free web plan and does not require payment details.
If paid web plans become available, their features, prices, renewal terms, and any charges will be shown before purchase. We may use Paddle as merchant of record to handle payment, applicable taxes, invoices, cancellations, and refunds under Paddle's terms as well as ours.

Nothing in this section limits any rights you have under the Australian Consumer Law (see below).

Your content and ownership

You own the content you create and upload to the Service. Your projects, citations, bibliographies, notes, and documents remain yours, and we claim no ownership over them.

You grant us a limited licence to store, process, and display your content only as needed to operate and provide the Service to you. This includes, where you choose to use our AI-assisted features, transmitting the relevant content to our AI provider to perform the requested extraction or analysis, as described in our Privacy Policy.

We own all rights in the Service itself, including its software, design, and branding. You may not copy, resell, or reuse parts of the Service without our permission.

Citation styles

The citation styles and locale files the Service uses to format your references come from the open-source Citation Style Language project. Those files are maintained by the CSL community, not by us, and are used under the Creative Commons Attribution-ShareAlike 3.0 Unported licence.

We make no claim of ownership over the CSL styles or locales, and nothing in the section above is intended to limit your rights in them under that licence.

Availability and changes to the Service

We work hard to keep the Service available and reliable, but we provide it on an "as is" and "as available" basis and do not guarantee uninterrupted access. We may modify, suspend, or discontinue features from time to time. Where a change materially reduces a paid feature you rely on, we will take reasonable steps to notify you.

Australian Consumer Law

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that you have under the Australian Consumer Law or any other law where doing so would be unlawful. For major failures with the service, you are entitled to the remedies provided by law, including a refund where applicable. The disclaimers and limitations in these terms apply only to the extent permitted by law, and are subject to your non-excludable rights.

Disclaimers and limitation of liability

To the maximum extent permitted by law, and subject to the Australian Consumer Law section above, we exclude all warranties not expressly stated in these terms, including implied warranties of merchantability and fitness for a particular purpose, and warranties that the Service or its outputs (including citations and AI-assisted results) will be accurate, error-free, or uninterrupted.

To the maximum extent permitted by law, and subject to the Australian Consumer Law section above, Virtually Created Pty Ltd will not be liable for any indirect, incidental, special, consequential, or punitive loss, or for any loss of profits, data, or goodwill, arising from or related to your use of (or inability to use) the Service. Where our liability cannot be excluded but can be limited, our total liability to you is limited, at our option, to resupplying the Service or refunding the amount you paid us for the Service in the 12 months before the claim.

Termination

You can stop using the Service and delete your account at any time from your account settings. We may suspend or terminate your account if you breach these terms, if required by law, or if we reasonably need to protect the Service or other users. When your account is deleted, your content is removed as described in our Privacy Policy. Sections that by their nature should survive termination, including ownership, disclaimers, and limitation of liability, will continue to apply.

Governing law

These terms are governed by the laws of New South Wales, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of New South Wales.
